I too ride on the ball of the foot, On occasion my heel is on the stock exhaust guard.
Could be worse for larger footed but with my 9's I've gotten used to the "touch".

I shall counter on a 70hp bike, a 3hp gain is absolutely unnoticeable. You are paying for a different sounding muffler. I would guess that the good news is this new muffler does not lose any hp.:evil
