Sounds like the rear pivot bearings to me. You can verify with a third set of hands, ( or a finger) held in the gap, while moving the wheel.

Some have had success with tightening the pivot pins...

Mine's 3 yrs old with 4-6x annual use. No issues. Have had mostly good luck ordering HF replacement parts for other stuff in the past. Call the CS number on the website.

Mine was true to size, I Wear a Shoei XL (RF-1000) and the ZOX XL fit fine, but a little tighter in the chin. If your Chin protrudes, there might me an issue.
