Don't see the regulator has anything to do with it. I've had the same problem on my '11 GSA. Twice I ran out at 300 mi. Had to lay the bike over... upon filling still had 1-2 gallons in the tank....

Maybe someday BMW will see fit to put the fill plug in the right location so the level can simply be checked or topped up without first draining it into a graduated container.
