Not necessarily. It could be considered an AOW like a Serbu: No tax stamp needed. Also, if its old enough to be considered an antique or relic, the NFA rules may not apply. I need to check on that.
100+ to this advice. That gun does not appear to be old enough to be exempted, and looks to be cut down from a single shot sporting shotgun. Considering how it was discovered, it might be evidence in some sort of crime. If it was me, I would go to the nearest law enforcement agency and turn it over to them.
No way I would do that! The last thing you want to do is to be in possession of something like that, even though you found it. BATFE would be at your front door the next day with a search warrant. I'd be inclined to re-bury it. If you dug it up and took it anywhere, you could be prosecuted on felony charges just for having possession of it. What you could have done, if so inclined, would have been to call the cops and tell them what you found and let them come out and take it away.
Better wrap it in tinfoil. That will keep the black helicopters from knowing you have it. oser The only way any LEO would care about that rusty POS is if you used it as a club to rob someone. As bad as it looks, it's debatable whether or not it would even be classified as a firearm anymore. Ask around at a local museum. they may know someone that could date it.
Ever deal with the BATFE? I have. I was licensed for 15 years until Clinton decided to get rid of half the licensees. The last thing anyone needs is to come to their attention. Ask the folks down in Hillsdale County that were falsely accused of being terrorists. After they were let go without being convicted, they got back about 10% of what was taken by the government. Remember, all it takes is to be accused of something that disqualifies you for firearms possession, something as simple as misdemeanor domestic violence, and they can come and clean you out. You won't laugh much then.
Like I said, the hired help took it to his little ranch he's got here in the states to hang above the fireplace or wherever. He found it about 200 yards north of the border, so undoubtedly it was brought across the border from the little village and dropped by an illegal. Who knows how long ago though. I'm more interested in seeing what model and how old it is. From the pics (I haven't seen it in person yet), it looks too old to operate and I really doubt the local BATFE office 2 hours away would be interested. If it's taking them 9-10 months to process my tax stamps as of late, they should have better things to be doing. Worse comes to worse, I'll call up my buddy over there and see what he thinks. If it is older than 1899, it wouldn't fall under 1934 NFA regs. Maybe he'll let me clean it up for him and see if I can determine any marks on it. But no one on here can identify this? Breech load, open hammer, with the breech lock above the hammer (seems odd to me).
I second this. When my grandfather passed, my relatives found a lot of really old ammunition in his workshop. In an attempt to do the right thing and dispose of it properly, they contacted the LEOs. LEOs called the BATFE. That did not go so well. I'll leave it at that.
Gaaa! You gave away ammo?! BATFE can't do much about ammo, unless there were some DD's (destructive device = hand grenade, 40mm projectile, etc). BATFE can't even regulate how much ammo you buy or stockpile.
I didn't. Family did. It was stored in the back of his workshop, and there had been a leak in the roof. They said there was corrosion on just about every case. Me, I say that is what revolvers are for. Shoot the questionable ammo out of the revolvers, they can take it. BATFE can't do much at all in this case, but it didn't stop them from trying. They harassed the hell out of my family.
Actually AOWs do need a tax stamp. Just a point of fact. As for that old sawed off? I'd recommend taking a torch to it and cut it into a dozen pieces.

Picked it up last weekend. 308 Remington 700 SPS tactical. Had the Nikon 5-20/40 mounted on cheap rings and rails. Yesterday went and got new rail and rings and Harris bipod. Love it. Gonna change out the stock soon I think
