OK how should this been handled?

About a week and a half ago a 50+ year old man comes in asking about an Burgman 650. Offers are made and rejected. He shows up the following day and decides he wants the Burgman and a sales contract is started. He wants an specific Helmet that we don’t stock but can get it is ordered along with a Tourmaster 2XL jacket in High-Viz and Tourmaster pants after an lengthy conversation about ass-less chaps and he is convinced the Tourmaster pants are the better choice. He is satisfied with the price, signs all the paperwork and is unconcerned with having to order the Helmet and jacket since he will not be picking the Burgman up till Saturday.

Saturday afternoon comes he and his wife show up he picks up his gear is happy with the Helmet. Is taken to service and is given the pre-delivery checklist all questions answered and he signs for delivery, makes a few laps around the parking lot and leaves roughly at closing.

Tuesday morning at 8:31 am the phone is ringing and he is calling wanting/demanding to return the Burgman. Questions are ask and answered and it turns out the issue is not the Burgman but he has changed his mind and now feels motorcycle riding is not for him.

The Burgman has right at 120 miles on it a sales contract has been made, loan approved, title applied for and vehicle delivered on his terms and in good faith.

How would the inmates handle this?

I suspect offering to buy the bike back at wholesale value might cause the customer some concern? It's certainly not NEW any more.

Buy the bike at trade-in value.

Otherwise the moron can sell it on his own.

Over the years I've heard a good amount of these stories (ours were mainly Honda stories since that was the dealership in our town, and the dealership I eventually worked at part-time). Yeah, he's got to man-up and sell it on his own unless he's willing to sell it for trade-in value to you. That's the way it is with anything like that.

No one is responsible for insuring that others like motorcycling. (I'm dealing with this now with the guy I sold my last bike to - a 1997 for $1450 that was running like a top when I sold it, and he's keeps calling amazed that maintenance, or keeping it out of the rain, or XXX, are an issue. All of those are aspects of motorcycling many don't take into account.)

"I'm sorry to hear that motorcycling is not working out for you. You seemed quite sure when you picked the bike up on Saturday. Perhaps you should consider signing up for some training"

"OK you are certain you want to return the bike? No problem! With only 120 miles on the clock, perhaps we can re-sell it as a demo, which means we can give you $XXXX (insert reasonable buy-back price here) for it - unless you would like us to put it on consignment for you? We can possibly find a buyer for your used gear as well, although you might find it easiest to sell it on eBay or something like that."

You have given him what he wants and made it clear that you will not simply be unwinding the deal and accepting a used bike on the showroom floor

No North Carolina does not have a 72 hour return rule.

As it stands he was given the offer to list the bike for sale as an consignment he refused.

After several hours of him and his wife storming around the store he said he would pay the depreciation. He feels the bike is still new. So how much depreciation does an 2012 Burgman 650 with 120 miles on it have? and can you void a contract when the title paperwork has been submitted?

I am just an Parts guy and do not get involved with other areas but if it was my store I would not of taken it back.

He is an reasonably intelligent man, did not do an spur of the moment decision. Discussed buying and Financing on Tuesday, signed the paperwork on Wednesday and he made the choice not to pick it up till Saturday. He had it in his possession From Saturday Afternoon till Tuesday Afternoon.

The wife's the problem. She probly returns half of the shit she buys, and thinks it works for everything. Even legal contracts. And she's probly holding out on the old man until he takes it back........

Hmmm, just looked it up, most sites state 20 to 25%

Bought a used K12GT at *BMW Shop*. Did most of my maintenance at home, while ordering my parts from *IH BMW Shop* (tire changes and gear too). Sold the bike to a gentleman and suggested that he take it there for a new rear tire. The owner fed the guy a line about what horrible shape the bike was in and how it may have been wrecked. I called the shop to speak with the owner and reminded him that I am a customer of his shop. He stated flatly that I just parts from him and my oil at Wal-Mart, and in his words, "You're not my customer". He lost me and the new guy who bought my GT. Too bad!
