It was slipping when i got it, i tightened it up after inspection showed the disks were in spec and now it drags with the lever pulled; enough to kill it after 3-4 seconds even with throttle.

I wouldn't be. I've had three bikes stolen from me, and I'm sure they circulated to unknowing buyers with little or no paperwork. I hate thieves. In Washington, buyer and seller can go to the DMV and fill out an "Affidavit of Lost Title and Bill of Sale", and the new title will be issued to the buyer.
To me, unwillingness to do that = no title and the seller is aware there is a problem. Which also equals me buying stolen property, so if the VIN is ever checked I'm out the price of the bike I no longer have plus a lot of explaining.
Pass.
