In this case a strong leaning twards yes. Im not a lawyer though. But in the case in point it sounded like the truckdriver was driving away, not walking to his vehicle.

I'd be willing to bet my ass that the truck would drive just fine. I love the liter factor in cases like this. I quickly hit fast forward and they disappear. Sad to hear of what happend though :(

Total bs on both sides. 3 shots fired first on an exit ramp, biker followed and fired 2 more times at him on east William st, then pistol whipped him with a nd that grazed his head in the AutoZone lot. This wasn't sd. On the ramp maybe it could have been. But chasing him down to a parking lot,firing twice more,then pistol whipping him at a third stop.... I'd press for attempted murder. Unless we're missing something here. If that account is fairly accurate,its a huge black mark on ccw in Ohio.
