EXACLTY!! My bike got hit by some old lady in the Walmart pkg lot and had to let insurance companies duke it out. In most big cities in TX the cops will only respond to a T/A on private property is if there are injuries. Luckily her company was way easy to deal with and just went to the Honda shop and wrote a check.

A public parking lot is one that is open to the general public. Ownership is irrelevant. A good example is the lot of a shopping center. While it could vary from municipality to municipality, generally the vehicle code applies and is enforcable in these lots. This is why you see stop signs, this why you could get a parking ticket, etc. in lots that are open to the public.

If you pave your on lot for your own personal use, and it is not open to the general public, you can ignore the vehicle code and drive how you damn well please.

Nope, LittleRedToyota has it right. I have seen several people (in Texas at least) who have been in fender benders in parking lots and the cops just say "sorry". It is totally up to the insurances involved at that point.

I did have someone ask me if it was too hot to ride a few months ago. I was at a loss as to what to say, seeing as how I had ridden to the gas station.

As I said, it could vary between municipalities. I know for a fact that here in CA the vehicle code is enforcable in parking lots open to the general public. Whether the local cops choose to enforce it is an entirely different matter. LAPD will generally not respond to fender benders, even on public roads, unless someone is bleeding. Ask me how I know.

And as far as insurance goes, guess what laws would be invoked should the case go to court?

no, it's not. the legal defiition of a public parking lot (or public anything) is one that is owned by the city, state, country, etc. anything owned by a private entity...like a shopping mall...is legally defined as private property. there are laws that apply to private property that is generally open to the public that do not apply to private property that is not generally open to the public, but that does not make them public property.

One of my daughters friends was at the house this past weekend, and when her mother came to pick her up, she wanted to see my "new to me" motorcycle... '05 Suzuki S40

She asked "How much did it cost?"

"$1,900" I reply.

She then exclaims "$1,900!!!??!! THAT'S IT? NOT $19,000?!? You got a great deal!!"
