I think municipalities go the route of refusing the claim in the hopes you'll just go away. Sure; they'll eventually settle but it's going to take a while and you're gonna have to work for what's due you.

I can't believe you're still fighting with the city over this! I know small governments are slow, but this is freaking ridiculous. Good luck man.

Yo, AJ... It's Kraut (obviously).

Are you REALLY still dealing with this? I don't know if you saw my thread or I told you, I can't remember... but I got rear ended last Sunday. She's clearly at fault, but you know how it goes...and some other things went down that I can't talk too publicly about, so I lawyered up, unfortunately. I also came away with some crappy injuries...MRIs were yesterday.

I can't believe you still don't have a conclusion to this. I hope mine doesn't take that long...

supposedly, it can take quite a long time. Im going to wait a little while longer then press ahead with Small Claims.

Bummer about your injuries.... but at least you can stand to get a real settlement for it....

Just browsing through here and found this. Don't wait any longer. Sue them. That will get everything rolling much faster. File the papers to take them to small claims court, and get them notarized and sent registered mail. Or delivered by a deputy, as some states/counties require. Get it resolved. Waiting longer just means they are looking for a way out by waiting you out.

Somebody posted a link a ways back that says that California small claims courts will take a local government case 45 days after the claim with the government is first filed and consider the claim as good as denied due to the 45 day delay.

But...even if you win, how do you get the city to pay?

That's not a problem, you have a court order for them to pay - take it to the City Clerk and they will point you to the right office where it will take them about 72 hours to cut the check. They really don't want to go back to court for you to get a till tap (one time emptying of the cash drawer up to the amount of the court order to satisfy the judgment).
