Hard pannier mounting flush with top of seat - Pros/Cons?

Should hard panniers be mounted flush with the top of the part of the rear seat or parallel with the ground? Also, how far forward or backward should they be mounted?

From the photos I've seen it appears most people mount their hard panniers flush with the top of the rear seat. This leans the panniers forward which follows the lines of the bike. The top box is then mounted at the same angle as the panniers. This makes sense if I wanted to strap down something that extends from the top of one pannier then across the seat to the other pannier. But, if I ride with a passenger their backrest is now leaning forward.

Open to ideas...
