New USFS penalties

    Closures for good cause are mostly reasonable and many should be supported.

    This order applies the penalties to anything with a "CLOSED" sign stuck to it regardless of the reason.

    It applies to any area, building, structure, campground, or recreation site posted as "Closed".

    While the stated purpose is for the protection of property, public health, and safety there is no binding legal requirement to justify that when citing someone for violating a “closed” posting.

    It might be possible to attempt using “stated purpose” as a defense in federal court, that would likely cost way more than the $5000 (max) fine just to grease up your lawyers.

    As I understand it all BLM and USFS fee sites are closed. That generally means campgrounds with facilities and some parking areas. Around here it would mostly be river access sites. There may be a few trailheads that are fee sites, but not many.

    I talked to a USFS enforcement officer the other day, looked like he was just out having a good time driving around. Didn't really seem to know what was going on as far as trails being closed or even that the government was "shut down" :rofl Seemed like a nice guy

    Yeah, my daughter and I were a couple of those scofflaws hiking up by Sunrise last Friday. Funny, when the "trails and facilities are closed due to the government shutdown" they don't look any different than they did when they were open. :lol3

    Ya, I drove by there Sunday. There were lots of cars.

    My thing was like they closed indian creek campground and there is never anyone there anyway. I guess if they don't know how long before they open the toilets might get full and the money box might get to full?

    The private campgrounds are making bank. Which I am all for! They are usually cleaner anyway.

    That is pretty crazy. I have done sections of the PCT. It would suck big time with that much commitment.

    Really when your out there the government is the last thing I would be thinking about.

    Here is an article in the Idaho Statesman regarding what is closed. They have a FWS LEO patrolling the Deer Flat National Wildlife Refuge looking for violators now. I have lived near Lake Lowell and hunted and hiked out there for over three years now and have never seen a LEO out there. Why should that change now just because it the government is shutdown?
