Ticket from plane on PCH..any tips?

    OK, so yes, I was riding on PCH between Muir Beach and Stinson beach and let's say that maybe I was speeding and overtaking on double lines...maybe once...:D

    CHP is parked around a very blind and slow bend and I pass him thinking there's no way he saw me do anything...he pulls me over...yada yada...and points up at the small plane buzzing around overhead.

    He was an alright guy, said they were having a crackdown, let me off the speeding and wrote me a ticket for crossing double lines.

    Any advice on fighting this?

    2 words: Traffic School

    I know you'll have to come down here for it and you'll probably get another ticket on your way down or back up.

    Do the crime do the time. :D

    A few times when I've fought tickets the cop doesnt show up and it gets dismissed.

    Anyway when an officer pulls me over and asks,
    do you know why I pulled you over?
    I respond with what I was called on this site.
    I respond,
    Because I am a n00b!
    They take two steps backwards running
    the legal definition of n00b through their brain,
    (confessing to being a n00b, or going a tad over the limit has never led to a charge yet) and they let me off with a warning.

    This is not legal advice,

    that I have not been pulled over by an officer,

    I have always argued
    that if you can get the ticket dismissed,
    by paying and going to traffic school.
    You should not have been given a license in the first place!
    And the MVD persons,
    that gave you,
    your license have opened themselves to a civil law suit.
    For passing a person, and allowing them a license,
    that have not been properly educated
    on driving a motor vehicle.

    I already have an Operators License,
    why would I admit, or confess,
    and
    go to a driving course,
    thus admitting,
    I do not know how to drive?

    I know you all do it for the children,
    so they have to,
    and do it because it lowers your Insurance rates,
    and they only sold me the policy because
    I agreed to be reeducated at anytime needed, to lower my rates
    and admit guilt for driving.

    I thought ignorance
    was not a defense to the law,
    but it appears to be on traffic tickets,
    and they let you off, and educate,
    you on the law.

    I respect you
    for not feeling the need
    to be re-trained
    on the current license you have.

    A Driver License is not a report card
    of how many times you passed driving school!

    I live in the general area of Sacramento, generally considered to be NorCal. Done traffic school a bunch of times.
    When your ticket comes in the mail, there will be a menu of choices for payment.
    One of those will be to pay the fine, pay an admin fee, and request
    to be allowed to do traffic school. YMMV

    What county was the ticket issued in?

    You have the right to request a trial and to have that trial take place in the county seat of whatever county the ticket was issued in. This may or may not help depending on where the officer who wrote you up is stationed.

    You can also get continuances and ask for a night court appearance if the offense occurred during the day in hopes that the officer won't appear.

    By writing you for the double yellow violation, he/she took away your ability to subpoena the officer in the plane to testify about observing/clocking your alleged speed.

    Or you could call the court and ask for a trial by declaration and hope...

    Van XR suggested I'd have to come down to SoCal, so I explained ticket was issued in NorCal. Stinson Beach is north of SF last time I checked. I can't do traffic school as I did it 6 months ago.

    One or two useful tips...thanks. :thumb

    You'll have to deal with it in the Superior Court of the county you were cited in. Was the violation 21460(a)? In San Mateo county it costs $237 and another $49 in 'administrative fees' if you opt for traffic school plus whatever the school you choose charges you, somewhere between $20 and $50 and you can only repeat T school every 18 months. The violation by itself is eligible for T school but your record will determine if you're eligible. So, if eligible it will cost just over $300 to keep it off your record and UNreported to your insurance company. If not, just $239 plus whatever your insurance company adds to you're premium.

    As I understand it, you can try to challenge, and hope that the officer that wrote the ticket appears in court. The evidence he presents will be "hear say" therefore in admissible for a traffic offense. If the actual observer appears may have to just take your lumps.
    But, please some research.
