    On June 30 I was rear-ended on my way to work. I held off posting until the insurance wrapped up. Here's what I wrote at that time:



    Riding to work today through the midtown tunnel (New York City), I got rear-ended by a BMW sedan. We were in heavy traffic. I was actually at a full stop (0 mph, feet down) about 7-10 feet from a Lexis SUV ahead of me.

    I didn't see the BMW coming. Everything was cool one moment, and then I'm flying forward. I was on the left side of the left lane. Bike smacked left side of Lexis' bumper, and went down, with me on it. The BMW driver was ashen faced, and started crying. (~40 y/o woman.     No broken bones, thankfully. I was able to get up, and right the bike. Police cruiser was about two lengths behind our mess, in the other lane, so scene was secure almost immediately. Pics of the scene:

    Was feeling OK, but starting to feel a bit sore now... neck, back shoulders. Bruise on left shin, soreness on right thigh. Was wearing full gear (Aerostitch pants, gloves, FG mesh jacket, Arai helmet, steel-toe 8" boots).

    Afterwards, at the plaza on the Manhattan side (while police Sergeant was collecting details) driver of BMW said something about "I guess my foot slipped!" "I'm so sorry!" "It was sunny outside, and in the tunnel..." Blah blah blah.


    Epilogue:

    It's been a bit over a month now since my get-off. I just got the final word from the other driver's insurance company. In short, they're going to stiff me about $1000-$1300, based on what it would cost to replace all the stuff which was destroyed.

    They valued my bike about $1000 *below* the NADA book value. I asked them how they came to that number -- they sent me a report. The report contained six "comparable" vehicles. Impressive, right? Well, I start searching the internet for the VINs they listed. I was able to find 5 of 6. Four of five of the "comparables" were obviously *wrecked* prior to being sold. (Road rash, bashed fairings, NO fairings, etc.) The fifth had NO pictures on line, but was identified as a "Repo Title".

    All this meant nothing to them. If I didn't like it, I could sue. :baldy

    In case you were wondering, her insurance company was Allstate. They've been bastards throughout this whole ordeal. I don't know how the claims adjusters can sleep at night. I did nothing wrong except wake up that morning, but I'm anything BUT whole. (The police report is a thing of beauty. The driver admits fault. Police interview with SUV driver confirms we weren't even moving.) My guess is that Allstate has a computer model which tells them exactly how little they can pay, but just enough that it's not worth my time to sue their driver. Fuckers.

    So talk to an attorney BEFORE you accept the payment, to decide if that is in your best interest. There are plenty of good attorneys worth their salt who will give you a free initial consultation and give you guidance as to the best way to proceed -- whether your inconvenience is worth the hassle of a lawsuit or whether it is not.

    Yeah, did that. I figured I was going to get screwed, so I found a lawyer right away. His advise after a few rounds w/ Allstate: That's as good as it's going to get. Would be easier if you were seriously injured.

    Have to agree with your comments on Allstate, I WAS with Allstate for over 20 years, my son had one accident that totaled the car and took like 6 weeks and 20 phone calls for them to get around to issueing a check. Agent wa NO help either keep giving me the BS "That's Claims I cant do anything about it" So I said "What the hell are you good for collecting my check? and of course you could not buy one in the same condition as yours for the chump change they gave you. but no injury so it was not worth a suit. I dropped them like 7th period math.

    I went with Progressive for all the bikes and Geico for the Autos. I figure If I have to do all the work anyway might as well do it on line

    Glad to hear YOU are OK could have been a lot worse. Like your new wheels.

    Allstate. i.e. AllRAPE, are the scum of the scummy insurance scumbags. Some kid hit my parked car several years ago. They did the same thing to me and I told them I'd see them in court. I set the court date and one week before they called and settled. If you don't have to have the money immediately I'd recommend trying it.

    Every single person I dealt with was an ass-hole right up until they called to settle. THen, all of a sudden, we were on the same side.

    How do I know?

    Happened to me last year. Flippen Honda hit me so hard my plate was reversed out in the hood two feet up from the edge. I just got the bike back to my home state from GA where I bought it. Did not even call my insurance comapny yet. I knew I had 30 days.

    Did not need it. The PU truck which my bike got thrown into was being driven by an off duty cop. I had great service.

    I initiated contact with the car drivers insurance company. resistance at first, then I just asked them to read the report and advised them I'll call back next week after the bike damage is reviewd.
    Next week, bike was total loss, 1994 K1100RS in red only 14K miles.
    So I call them again. Again they low ball offer " NADA " on bike, I say no way, you are off $1,200 easy, plus jacket, gloves & helmet all biffed and should be replaced. AND.... I need medical paid and all my rehab sessions.
    Once I am OK cleared by my DR, we'll discuss pain & suffering. If this is not acceptable plase advise within 24 hours and I will retain proffesional legal council.
    Picked up a full check three days later, then 6 mo later we setteld the P & S.

    I should have acted in pain a lot more AND taken an ambulance ride. No I did not need it, just saying I could have easily tripled the P & S damages if I had done that I thnk.

    All in all I'm OK with it, cept for loosing that beautiful bike. I bought another three weeks later with the $.:clap

    Sorry your bike got hurt, and sorry you are going through so much with the people who are supppose to look out for you. I agree sometimes all you have to do is threaten legal action and you will get better service. You need to be mindful before signing anything that soft tissue injuries can take a long time to heal and oftens times wont even become apparent until swelling goes down etc. My friend was sideswiped on the freeway almost a year ago (in a car fortunately) but she started developing headaches and chronis pain 3 months after the accident. Fight for yourself you are worth it. Dont let those guys railroad you into settling for less than what you are worth. Hope all ends well. Good luck and pretty bike. I like the lighter colored bikes alot maybe you will be more visible on it.

    ANY time you are involved in an accident like that, you want to go to the hospital for a checkout at the minimum. Make sure any and all injuries are documented and if you have subsequent complaints, go back to the same place so that your file is consistent.

    First off, medical claims HAVE to be settled within one year of the accident.

    Secondly, you will be in a much stronger bargaining position. Do not, EVER, sign a release of liability, at least without a clean bill of health from your MD. Tell them to pound sand and get a lawyer. You'll be amazed at how much a rear end collision with medical problems can get you.

    That doesn't seem right. They should make you whole. What about loss of use of your bike, rental, inconvenience etc. Maybe you should just send them the bill for your new bike. Try a different lawyer. I have always heard that the insurance company will offer little when it is just you, but when you get a lawyer you get (or the lawyer gets) a lot more.

    A few years ago I was talking to a neighbor. A dump truck stopped at the end of the cul-de-sac, driver got out and walked over to the house he was working on. The dump truck started to roll, ran over another neighbor's mail box, gained speed in 30 feet hit his garage and rear ended his 10-15 yr old car parked in the drive way, and ripped part of his deck off the house before coming to a stop.
    The neighbor was napping and walks out to a totaled car and messed up house. He got his house fixed for free but they only gave him blue book for the car. I would have wanted a new car of my choice within reason.

    Well Insurance companies went to crap in the 80's.

    I actually posses a degree and certificates in Banking and Insurance, but I refuse to work with them or for them. They are unethical and criminal organizations that are lower then low. They rate on the same level as lawyers and politicians. Maybe even lower, if that is even possible.

    In the Face Plant spirit of things:

    Watch your 6. I have flashy blinky LED brake lights on all of my bikes and, once stopped, always reapply them when a car is approaching me from the rear. Of course there's no guarantee that will save me but it certainly doesn't hurt.

    One thing I learned here on ADV was to stay way left or at least have your front pointed left when stopped. (Assuming you're riding the left side of the lane.) That way, in the event that you are rear-ended, you'll be pushed off to the side instead of becoming the meat part of a car sandwich.
