Why doesn't the F800GS have a rear fender?

It has as much rear fender as any other dualsport. If you mean the useless little crap catcher like the big GS has hanging behind the wheel, it's just one less thing to remove or break off anyway.

from what I've read the rear fender was added because of a regulation requiring a certain amount of the rear tire be covered.

Fairly certain guavadude was referring to the big GS.

I was just trying to give some background info.
I read somewhere that the rear fender was added to the 1200gs and the single f650gs to meet a Euro code.
I'm guessing the 800 doesn't have it because if you ride off road they usually break.

On mine the license plate and it's required light fixture mount to the fender. If ya don't have a fender where do those things go?

most of the stuff above the rear tire is gas tank, the underside of which performs the "fender duties".

And why would ya ask this question? are you a fender fetishist?

Hmm well the reason usually given for the crud flap on the 1200GS is that German type approval apparently requires a dirt/mud deflector within a certain distance of the axle height. Wonder of the license plate mount on the F800GS just meets that requirement, or whether Germany has changed the rules.
