Possible fraud website in UK - Formotorbikes.com - need help

    Hello good people of Advrider

    I am kinda new here, but not so new to motorcycles. Having got a GS, I wanted to get some decent riding gear and we don't have as many choices in India. Almost all my gear has been ordered from RevZilla and the experience has been nothing short of amazing.

    When the time came to get a new helmet, I thought Nexx Carbon Zero XWST2 would be nice to have and RevZilla were (still are) out of stock. So I chose to order from this UK based website called www.Formotorbikes.com where I was assured they had stock of the helmet I wanted.

    I placed the order for the helmet with them on 4th June (2018). Paid 350 GBP (about 470 USD) plus 70 pounds shipping so total 420 pounds via Paypal. I did not receive any response from them for a month. I kept following up and they kept committing that every next week they'll ship the helmet. Frustrated, I asked for a refund around 4th July and they initiated it. Got the notification that refund will be done in 7 days time. On the day the money should have been in my account, I saw that the refund has been cancelled. Apparently you can't raise a dispute about this on Paypal.

    I am super angry with them and I don't know what to do. I checked on facebook and they have received a couple of such bad reviews. But my friend has received his Nexx helmet from them, so they are not that fake I guess?

    Has anyone had this experience with them and can anyone based out of UK help out with this? The company is based out of Chester in the UK.

    I really don't know what else to do and a last resort would be to try to get in touch with Chester police or something. Any help on this would be really reassuring!

    You can file a claim with Paypal for "item not received". Paypal will get your money back unless the merchant has shipped your helmet and provides Paypal with a tracking number showing delivery.

    Have you tried the www.UKGSer.com forum? That is the UK version of this site.
    In any case PayPal should help you return your funds.

    I have done this now. So far, it is awaiting sellers response. However, received a message from their FB page that the refund will be processed manually and it will take 24/48 hours. In my experience, they delay responses till friday and then push it over to Monday. On Monday they don't return calls / emails / messages etc and respond on Tuesday buying time for a couple of days.
    I bombard them with bad reviews and they respond on Thursday / Friday.. the cycle continues.

    This is my next plan. Will do it this week.

    I have posted a stinker of a review here. Turns out there are many people who are in a similar boat with these guys. I am contacting them so we can fight our cases together against this cheater.

    Ok morning all

    Good news.
    After two months of daily follow up, I have got my money back.

    First, as advised by Manray and Rider1150gsadv I raised a dispute with Formotorbikes.com on Paypal. They were dishonest on paypal claiming that my money was refunded and gave a transaction number on facebook messenger. I ran this by paypal team and they didn't seem to be very helpful on the subject at the time.
    A few days later, an email came to me saying that my claim has been rejected and the money is paid to me. WTF? So I was without my money and a claim which was settled in favor of the seller.

    Then started the long process of calls to paypal call centre and I had to make at least 20 calls and many of them got dropped when they put me on hold. But eventually they admitted that there is a fault here and will help out in recovering my money back. Few days passed without any communication so I brought this issue to the notice of paypal executive escalations.

    They understood the problem and a new claim was filed manually this time the result of the case was in my favor. yay!

    Somewhere early this month (August), I got a call from their office in Malaysia that the money will be returned to me and again its in the form of an e-cheque. So that meant a week's waiting - 7th August was the committed date.
    On 6th, I got an email - refund cancelled. Made the same calls again.

    I think by this time paypal team realized formotorbikes.com is cheating and is routinely cancelling e-cheques. To me this is proper fraud. I forwarded the cancellation note to paypal escalation team and I think this time they took matters in their own hands. They seemed to have intervened and asked the seller's bank to give me the money. So on 8th I got the money in my paypal account.

    Bottom line is formotorbikes.com claimed that they had processed the refund but I did not receive it after two attempts. I will ensure this experience is posted to as many biking forums as possible so that good people on two wheels don't suffer.
